Why would this affect my pothole claim -info on Highways act 1980?

After going over a pothole it caused �500 worth of damage to my vehicle - I submitted a claim to the council and a solicitor acting for the council declined my claim with reasons relating to the Highways act 1980 - why is this and how do I get around it
